Trump’s California ballot appeal puts Supreme Court in center of fight over allegations of noncitizen voting

Latest News CNN · FOX NEWS POLITIKOOL · LATEST NEWS

CNN · Fox News, Fox News and NPR report that the Trump administration has taken its fight with California over alleged noncitizen voting to the Supreme Court, one day before Election Day on Nov. 3. The Justice Department wants the justices to make the state hold back ballots from some 20,000 registrants it considers likely noncitizens until their citizenship is checked. Fox News says the department calls it a limited injunction that preserves the ballots without canceling votes.

A federal judge in Los Angeles and a divided 9th Circuit panel have already refused. Judges Mark Bennett and Gabriel Sanchez, appointed by Donald Trump and Joe Biden respectively, said the government should "take that suggestion to Congress, not the courts." They also cited the Purcell principle against late rule changes, NPR notes. Judge Patrick Bumatay dissented.

NPR adds that county officials found many people on the list had no active registration and received no ballot, so the true number is probably far below 20,000. It also reports that DOJ officials have threatened local election officials with prosecution and subpoenaed Los Angeles County Registrar-Recorder employees.
