Judge says Trump prosecutor in LA is ‘unlawfully serving’ in latest hit to Trump’s DOJ
MS NOW · The Independent and The Independent report that a federal judge has found Bill Essayli, President Donald Trump's pick to lead federal prosecutions in Los Angeles, is serving unlawfully. Judge J. Michael Seabright ruled Tuesday, but his decision is not yet in effect, and the question may end up before the Supreme Court.
Seabright, appointed by George W. Bush, called Essayli an unlawful "de facto" U.S. attorney. The Independent says Pam Bondi first installed Essayli as interim U.S. attorney on April 2 last year, then reset his time limit by making him acting attorney when 120 days expired. It adds that Seabright reconsidered after an August 9th Circuit decision on Sigal Chattah in Nevada, finding Essayli's designation under Todd Blanche no different. Courts have reached similar conclusions about Alina Habba, John Sarcone and Lindsey Halligan, The Independent says.
Essayli said the president and attorney general may choose Justice Department supervisors and that the Supreme Court will decide. MS NOW reports the Justice Department has asked the justices to take up the issue, warning of chaos for the next presidential transition. Seabright gave the government a chance to seek a stay while it appeals.
